What is a Trade mark?

A registered right to a name, logo or phrase for particular goods or services.

A trade mark registered with IP Australia gives you the exclusive right to use the mark for the classes you chose, and the standing to stop copycats and lookalike domains. Registration takes months; the earlier filing date wins.

Brand Guard can watch for new filings similar to your name where the register's API is connected.

What to do

  • Search the register before choosing a name.
  • Register in the classes you trade in, including the ones you plan to.
  • Beware of foreign 'trade mark registry' invoices; only IP Australia registers Australian marks.
